Overview

The world of international contracts never stops. It changes forms and volumes, and it is always

ready to adapt to the new circumstances and developments of the market. This is why knowing how to master the current and most recent trends relevant to negotiating, drafting, and interpreting the terms of international business agreements plays a fundamental role in achieving successful deals. A good negotiator is somebody who knows the market and can anticipate issues and problems, to avoid, as far as possible, any litigation. This practical course will examine advanced contracting trends that must be mastered by a negotiator who operates at an international level. It will also take into account the stakeholder's approach that is driven by the UN Sustainable Development Goals and the new US Statement on the Purpose of a Corporation of 19th August 2019, current musts for every company that operates globally.

The course will also cover current trends in the management of international disputes. It will investigate how to react when a serious dispute arises and how to adequately prevent onerous litigations. It will focus on mediation and discuss the importance of the Singapore Convention on International Settlement Agreements Resulting from Mediation of August 2019, analyzing how this will affect today’s international business. It will provide participants with knowledge of the new trend of Third Party Litigation, and how this can be useful to companies of every size. A particular focus will be on comparing the different approaches and peculiarities of various laws when dealing with procedural issues, such as document discovery and experts.

  • The increasing role of “special courts” such as DIFC Dubai International Finance Centre courts and SICC Singapore International Commercial Court
  • Gain insights into Corporate Social Responsibility, and the reasons of its increasing materiality for all oil & gas stakeholders, such as governments, oil companies and contractors


Each session will comprise formal presentation on each topic by the presenter, interactive discussion between participants, real-life examples and a range of exercises carefully designed to illustrate the issues under discussion.
